According to the judges' conclusion, refusal of military service does not prevent extradition to the country that was unlawfully attacked, and this individual is subject to conscription for military service. Neither the Constitution of Germany nor the European Convention on Human Rights contradicts extradition.
The request for the man's extradition came from Ukrainian law enforcement. According to their information, he fled Ukraine, and prior to that, during a medical examination in a Ukrainian hospital, he threatened a police officer and assaulted him.
The fugitive himself stated that he does not wish to return to Ukraine because he would have to serve in the army there. He claims that he does not want to kill people and refuses military service on moral grounds.
