The court has delivered a verdict
The preparation of hookahs is subject to a complete ban in the restaurant industry, regardless of their composition.
The relevant ruling was announced by the Supreme Court in a case brought by one of the LLCs against the State Consumer Service regarding the illegality of imposing administrative sanctions for the preparation of hookahs.
As noted by the Supreme Court, the courts of first and appellate instances, in granting the claims, assumed that there is no complete ban on providing hookah preparation services in Ukraine, which is incorrect. Instead, the Supreme Court concluded that providing hookah preparation services in a restaurant establishment is fully prohibited under part 2 of Article 13 of the Law of Ukraine "On Measures for Preventing and Reducing the Use of Tobacco Products and Their Harmful Effects on Public Health," as amended and effective from July 11, 2022. On this basis, the panel of judges of the Supreme Court annulled the decisions of the lower courts.
Let us remind you, that as of July 11, 2023, amendments to the legislation have taken effect, which prohibit the sale of flavored e-cigarettes.
