The child died due to a delayed decision regarding the cesarean section
The court found the obstetrician-gynecologist of a private clinic in the capital guilty of the death of a newborn.
This was reported by the press service of the Kyiv City Prosecutor's Office.
“The tragedy occurred in May 2020. During the delivery of a 32-year-old woman, the obstetrician-gynecologist made an incorrect assessment of the fetal CTG monitoring data and delayed the decision to perform a cesarean section,” the statement reads.
As a result, the newborn suffered irreversible damage to the central nervous system and died 55 days later. A forensic medical examination confirmed the causal link between the doctor's actions and the infant's death.
The doctor was found guilty of improper performance of his professional duties, which caused severe consequences for the minor (Part 2 of Article 140 of the Criminal Code of Ukraine). The court sentenced him to three years of imprisonment, along with a ban on practicing medicine for one year. This is the maximum term provided by this article, the prosecutor's office noted.
The court also fully satisfied the claims of the deceased child's mother for moral damage compensation from the clinic in the amount of 1,170,000 hryvnias.
